Local Government: Enforcement & Prosecution
Excelling in regulatory enforcement and prosecution, we have a long history representing councils in this area of the law.
EXPERTISE & EXPERIENCE:
Partner, Adam Hopkinson leads a prosecution and enforcement group that regularly represents local authorities, including Gisborne District Council, Western Bay of Plenty District Council, Tauranga City Council and Bay of Plenty Regional Council. In fact, we’ve been representing Western Bay of Plenty District Council and Bay of Plenty Regional Council for more than 30 years.
Our prosecution and enforcement work for Bay of Plenty Regional Council has included more than 100 prosecutions under the Resource Management Act 1991 for a wide variety of offences, and a number of enforcement order applications and abatement notice appeals.
Our regulatory prosecution and enforcement work for Western Bay of Plenty Council includes Resource Management Act, Building Act and Dog Control Act cases.
We have conducted a number of Resource Management Act prosecutions for Gisborne District Council relating to forestry non-compliance, as well as acting for Gisborne District Council in relation to enforcement order applications and abatement notice appeals.
We act for Tauranga City Council in Resource Management Act and Building Act enforcement matters.
Other regulatory work for local authorities includes conducting Dog Control Act prosecutions and appeals, advising on Building Act and Resource Management Act enforcement and advising on Bylaw enforcement.
The majority of the local authority prosecution and enforcement work is undertaken by Adam Hopkinson, Victoria Brewer and Rachael Zame, with support from other members of the litigation team.
